Welcome to the Home Care Success ConsultingTM website. These Terms of Use (“Terms”) govern your access to and use of www.homecaresuccess.org including its pages, forms, downloads, articles, resources, and other content.

In these Terms, “Home Care Success Consulting,” “we,” “our,” and “us” refer to Home Care Success ConsultingTM. “You” and “your” refer to each person or organization accessing or using the website.

By accessing or using this website, you agree to these Terms and our Privacy Policy. If you do not agree, please do not use the website.

  1. About Home Care Success Consulting
  2. Home Care Success Consulting provides business startup, operational, documentation, branding, and implementation support for individuals establishing or strengthening non-medical home care agencies in Connecticut and Massachusetts.

We serve Connecticut and Massachusetts only because these are the states in which our consultants have direct agency ownership and operating experience.

Information provided through this website is intended for general educational and business- planning purposes. Visiting the website or submitting a contact form does not create a consultant- client relationship.

  3. Eligibility
  4. This website and our consulting services are intended for adults who are at least 18 years old and legally able to enter into binding agreements.

By using the website, you represent that you meet these requirements. If you use the website on behalf of a business or organization, you represent that you have authority to act on its behalf.

  5. No Professional Legal, Tax, Financial, or Medical Advice
  6. Home Care Success Consulting provides business consulting and implementation support. We are not a law firm, accounting firm, financial advisory firm, government agency, licensing authority, or medical provider.

Website content and consulting resources do not constitute:

    • Legal advice
    • Tax or accounting advice
    • Financial or investment advice
    • Medical or clinical advice
    • A government determination
    • A guarantee of registration, enrollment, credentialing, reimbursement, approval, profitability, or regulatory compliance

You should consult an appropriately qualified attorney, accountant, insurance professional, financial adviser, or other licensed professional regarding matters requiring specialized advice.

  7. Regulatory Information
  8. Home care laws, regulations, application requirements, fees, forms, agency interpretations, and government procedures may change at any time.

Although we make reasonable efforts to provide accurate and useful information, we do not guarantee that every website page, template, checklist, link, form, or resource will always reflect the most recent legal or regulatory change.

    You are responsible for:

    • Verifying current requirements with the appropriate government agency
    • Reviewing and customizing all documents for your business
    • Obtaining legal or professional review when appropriate
    • Maintaining your agency’s registrations, insurance, filings, policies, and records
    • Operating your business in accordance with applicable laws and requirements
  9. No Guarantee of Results
  10. Business results depend on many factors outside our control, including your experience, decisions, effort, implementation, finances, market conditions, competition, staffing, management, and compliance practices.

    We do not guarantee:

    • Approval of an application or registration
    • Acceptance by a payer, referral source, or government program
    • A specific launch or opening date
    • A specific number of clients, employees, referrals, or contracts
    • Revenue, profit, reimbursement, funding, or business growth
    • First-page search-engine rankings
    • Error-free documents or uninterrupted website performance
    • Ongoing regulatory compliance

Examples, testimonials, projections, or descriptions of past results do not promise that you will receive the same outcome.

  11. Website Information Is Not a Consulting Engagement
  12. Submitting a website form, requesting information, downloading a resource, joining a waiting list, or participating in an introductory call does not create a consulting relationship.

A formal consulting relationship begins only after:

    • We confirm project availability;
    • Both parties sign the required consulting agreement; and
    • Any required initial payment or other onboarding condition is completed.

Until then, we are not obligated to accept, begin, reserve, or complete a project.

  13. Priority Project Queue
  14. When our current project capacity is full, prospective clients may request placement in our Priority Project Queue.

Placement in the Priority Project Queue:

    • Is not a consulting agreement
    • Does not require a deposit unless separately agreed in writing
    • Does not guarantee acceptance of a future project
    • Does not guarantee a specific start date
    • Does not create an obligation for either party to proceed
    • May require updated information before a project begins

We will contact prospective clients when an appropriate opening becomes available. Project availability, scope, timing, and eligibility must be confirmed before services begin.

  15. Service Agreements Control
  16. Paid services may be governed by a separate proposal, consulting agreement, scope of work, payment agreement, or other written contract.

If these website Terms conflict with a signed service agreement, the signed service agreement will control regarding the specific services covered by that agreement.

Prices, payment schedules, project timelines, deliverables, revisions, cancellation terms, and refund conditions will be stated in the applicable written agreement. Prices are not required to be displayed publicly on this website.

  17. Intellectual Property
  18. Unless otherwise stated, the website and its content are owned by or licensed to Home Care Success Consulting and are protected by applicable intellectual-property laws.

  21. Purchased and Customized Materials
  22. Rights relating to paid Blueprint materials, customized documents, websites, logos, marketing materials, and other deliverables are governed by the applicable consulting or licensing agreement.

Purchasing or receiving a deliverable does not automatically transfer ownership of Home Care Success Consulting’s underlying systems, methods, source templates, training materials, or intellectual property.

Unless your written agreement states otherwise, deliverables are licensed for the purchasing client’s internal business use and may not be resold, redistributed, sublicensed, or used to provide consulting services to others.

  23. Your Information and Submitted Materials
  24. You are responsible for ensuring that information and documents you submit are accurate, lawful, and authorized for our use.

    You represent that:

    • You have the right to provide the submitted information;

Please do not submit client medical records, Social Security numbers, banking credentials, passwords, or other highly sensitive information through general website forms.

  25. Testimonials and Reviews
  26. We will not publish an identifiable client testimonial, photograph, business name, or case study without permission.

Testimonials represent individual experiences and do not guarantee that another client will achieve similar results. We may correct minor spelling or grammatical errors, but we will not materially change the meaning of an approved testimonial.

We may restrict or terminate access when we reasonably believe these Terms have been violated.

  29. Third-Party Websites and Services
  30. The website may link to government agencies, educational resources, payment processors, scheduling systems, social media platforms, or other third-party services.

These links are provided for convenience and do not necessarily constitute an endorsement. We do not control and are not responsible for third-party content, security, availability, accuracy, terms, or privacy practices.

Your use of third-party services is governed by their own terms and policies.

  31. Website Availability
  32. We may modify, suspend, restrict, or discontinue any part of the website at any time. We do not guarantee that the website will always be available, secure, current, complete, or free of errors.

We may perform maintenance, change website features, remove content, or update service descriptions without prior notice.

  33. Disclaimer of Warranties
  34. To the fullest extent permitted by law, this website and its publicly available content are provided on an “as is” and “as available” basis.

Home Care Success Consulting disclaims warranties of any kind, whether express, implied, or statutory, including warranties of accuracy, completeness, reliability, merchantability, fitness for a particular purpose, non-infringement, and uninterrupted availability.

Some jurisdictions do not allow certain warranty exclusions, so portions of this section may not apply to you.

  35. Limitation of Liability
  36. To the fullest extent permitted by law, Home Care Success Consulting and its owners, consultants, contractors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to:

    • Your unlawful use of the website
    • Your violation of these Terms
    • Information or materials you submit

    • Your misuse or unauthorized distribution of our content

This section does not require indemnification for conduct that cannot legally be indemnified.

  39. Privacy

  41. Governing Law
  42. These Terms are governed by the laws of the State of Connecticut, without regard to conflict-of-law principles.

Any dispute concerning the website or these Terms that is not controlled by a separate signed agreement will be brought in a court with appropriate jurisdiction in Connecticut, unless applicable law requires otherwise.

Before filing a legal claim, the parties are encouraged to make a good-faith effort to resolve the matter through written communication.

  43. Changes to These Terms
  44. We may update these Terms when our website, services, business practices, or legal obligations change.

Revised Terms will be posted on this page with an updated “Last Updated” date. Your continued use of the website after updated Terms become effective indicates your acceptance of the revised Terms.

  45. Severability
  46. If any part of these Terms is found to be invalid or unenforceable, that provision will be enforced to the greatest extent permitted, and the remaining provisions will remain in effect.

  47. No Waiver
  48. Our failure to enforce a provision of these Terms does not waive our right to enforce that provision or any other provision later.

Separate signed agreements govern paid consulting services and deliverables.
